These Terms of Service ("Terms") govern your use of fightthebitellcnj.com (the "Site") and the services provided by Fight the Bite LLC ("Fight the Bite", "we", "us", "our"). By using the Site, contacting us through the Site, or engaging Fight the Bite for services, you agree to these Terms. If you don't agree, please don't use the Site.
About us
Fight the Bite LLC is a New Jersey limited liability company specializing in residential mosquito and tick control services in Monmouth County, New Jersey. The company was founded by Anthony Howard in 2019 and is licensed and insured in the State of New Jersey.
Use of this Site
You may use this Site for personal, non-commercial purposes — to learn about our services, read our blog, and contact us. You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Submit false or misleading information through our contact forms
- Attempt to gain unauthorized access to any part of the Site or related systems
- Use automated tools (bots, scrapers, crawlers) to extract content beyond standard search engine indexing
- Interfere with the operation of the Site or impose unreasonable load on our infrastructure
- Reproduce, distribute, modify, or republish Site content without our written permission, except as permitted under fair use for personal reference
Service estimates and quotes
When you request an estimate or quote through the Site or by contacting us:
- The estimate is informational only until both parties agree on scope, pricing, and a service start date
- Quotes are typically valid for 30 days from the date provided
- Final pricing may differ from initial estimates based on on-site assessment of property conditions, square footage, vegetation density, and access
- Quotes assume reasonable property access; properties requiring extraordinary measures (locked gates, dogs not contained, hazardous conditions) may require additional fees or rescheduling
Service terms
If you engage Fight the Bite for ongoing service, the following applies in addition to any specific service agreement:
Property access
You agree to provide reasonable access to the property at scheduled service times, including unlocked gates, contained pets, and clear access to areas requiring treatment. Missed appointments due to access issues may result in a service-call fee.
Treatment safety
Our treatments use products labeled for residential use and are applied according to manufacturer instructions and EPA / NJ Department of Environmental Protection guidelines. We follow standard re-entry intervals: typically treated areas should be avoided by people and pets until visibly dry, generally 30–60 minutes after application. We will inform you when treatment is complete and dry. You agree to follow these instructions for the safety of your household.
Pollinators and beneficial insects
Fight the Bite uses application techniques designed to minimize impact on bees, butterflies, and other beneficial pollinators. We avoid spraying flowering plants when bees are actively foraging and time treatments to reduce non-target exposure. However, no insect-control treatment is fully selective; some impact on non-target insects is possible. By scheduling treatment, you acknowledge this trade-off.
Weather and rescheduling
We may reschedule treatments due to rain, high wind, or extreme temperatures that would compromise effectiveness or safety. If significant rainfall occurs within 24 hours of an application, we'll re-treat at no charge upon request.
Cancellation
You may cancel an upcoming scheduled service by contacting us at least 24 hours before the scheduled appointment. Cancellations within 24 hours may be subject to a service-visit fee. Recurring service agreements may be canceled with two weeks' notice.
Payment
Payment terms are specified at the time of service agreement. Standard terms are payment due upon completion of service unless otherwise agreed. Late payments may be subject to a reasonable late fee.
SMS messaging program terms
If you opt in to receive text messages from Fight the Bite via our contact form or any other consent mechanism, the following terms apply to the SMS program:
Program description
Fight the Bite operates two separate SMS message programs:
- Transactional messaging — Service appointment confirmations, reminders, scheduling updates, account notifications, and responses to your inquiries
- Marketing messaging — Seasonal service offers, treatment-season reminders, promotional announcements
Each program requires its own opt-in. Opting in to one does not opt you in to the other.
How to opt in
You may opt in by checking the corresponding consent checkbox on our contact form on this Site, or by texting a designated keyword to our messaging number if and when we offer one, or by other documented affirmative consent.
How to opt out
To stop receiving messages from either program at any time:
- Reply STOP to any message — you'll receive one confirmation reply and no further messages from that program
- Reply HELP for help and contact information

Frequency, costs, and supported carriers
Message frequency varies by program and service activity. Message and data rates may apply based on your wireless plan. We support all major U.S. wireless carriers including AT&T, Verizon, T-Mobile, Sprint, and most regional carriers. Carriers are not liable for delayed or undelivered messages.
Privacy
Information collected through the SMS program is governed by our Privacy Policy. We do not share SMS opt-in information with third parties for marketing purposes.
Intellectual property
The Site and its content — including text, photos, logos, graphics, blog articles, and design — are owned by Fight the Bite LLC or licensed to us, and are protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, modify, or republish our content without written permission, except as permitted under fair use (e.g., briefly quoting an article with attribution and a link).
"Fight the Bite" and "Fight the Bite LLC" are trademarks of the company.
User-submitted content
If you submit a review, photo, comment, or other content to us (whether through the Site, email, or text message), you grant Fight the Bite a perpetual, royalty-free, worldwide license to use, reproduce, and display that content for marketing, testimonials, and similar purposes. You represent that any content you submit is your own and does not infringe on anyone else's rights. We may decline to publish or remove user content at our discretion.
Third-party links and content
Our Site may link to third-party websites (e.g., government sources, news articles, partner businesses). We don't control those sites and aren't responsible for their content, privacy practices, or terms. Linking is informational only and doesn't imply endorsement.
Disclaimers
The blog articles and seasonal guides on this Site are educational, not advice. If you find an embedded tick and you're worried about Lyme, call your doctor — that's not what we're for. Same for legal questions; we're a pest control company, not a law firm.
While we make reasonable efforts to keep Site content accurate and up to date, pest behavior, regulations, and product availability change over time. We make no warranty regarding the accuracy or currency of educational content.
Results depend on your specific property, what your neighbors do, the weather, and a dozen things outside any pest company's control. We don't promise zero mosquitoes or zero ticks — anyone who does is selling you something. We aim for significant reduction in the areas we treat, and we'll talk through realistic expectations when we walk your property.
Limitation of liability
To the fullest extent permitted by applicable law, Fight the Bite LLC, its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services, including but not limited to loss of profits, data, or property damage, except in cases of gross negligence or willful misconduct. Our total liability for any claim relating to a paid service shall not exceed the amount you paid for that service.
This limitation does not apply to liabilities that cannot be limited under applicable law (such as gross negligence, willful misconduct, or personal injury caused directly by us).
Indemnification
You agree to indemnify and hold harmless Fight the Bite LLC from any claims arising out of your violation of these Terms or your misuse of the Site, including reasonable attorney fees.
Governing law and dispute resolution
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services shall first be addressed by good-faith communication between the parties. If unresolved, disputes shall be brought in the state or federal courts located in Monmouth County, New Jersey, and you consent to personal jurisdiction in those courts.
Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top of this page. Continued use of the Site after changes constitutes acceptance of the updated Terms. For material changes, we'll provide more prominent notice.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
